As of October 3, 2023, Session Law 2023-134 became effective, which provides revisions to North Carolina General Statute § 143-49 Powers and duties of Secretary.

As part of these revisions, a clause must be included in all contracts awarded by the state, and departments, agencies, and institutions of the state, providing that the following entities may audit the records of the contractor during and after the term of the contract to verify accounts and data affecting fees or performance:

An amendment template is now available to assist agencies with amending contracts that were affected by Session Law 2023-134, which went into effect as of October 3, 2023, and provides revisions to North Carolina General Statute § 143-49 Powers and duties of Secretary.  

Any contract awarded by the state, and departments, agencies, and institutions of the state, on or after October 3, 2023, must contain this language.
